Purpose

These General Terms and Conditions of Sale (GTC) govern all sales concluded between the seller (hereinafter “the Company”) and any buyer (hereinafter “the Customer”) placing an order through the online store. Placing an order implies full and unconditional acceptance of these GTC.


Products

The Company designs and sells sailboat autopilot systems of its own conception. Each system is delivered complete and includes the following components:

  • A tiller electric actuator, providing mechanical actuation of the tiller
  • A motor controller, driving the actuator with precision
  • An onboard control server, integrating a 9-axis inertial measurement unit (IMU) for heading, roll and pitch sensing, and running the control logic
  • An Android application, serving as the user interface for parameter adjustment, desired heading input and real-time monitoring of the autopilot

The complete system is designed and assembled by the Company.


Pricing and Payment

Prices are stated in euros inclusive of all applicable taxes, excluding shipping costs. Full payment is due at the time of ordering. The Company reserves the right to modify its prices at any time; the applicable price is the one in force at the date the order is placed.


Delivery

Delivery times are given as estimates only. The Company cannot be held liable for delays attributable to the carrier. Risk of loss or damage passes to the Customer upon handover of the parcel to the carrier.


Right of Withdrawal

In accordance with applicable regulations, Customers qualify as consumers have the right to withdraw from their purchase within 14 days of receiving the product, without providing any reason. Return shipping costs are borne by the Customer. This right does not apply to units manufactured to the Customer’s specific requirements.


Warranty

Products are covered by a 2-year commercial warranty against manufacturing defects under normal conditions of use. The warranty does not cover damage resulting from incorrect installation, improper use, impact, water ingress beyond the product’s rated protection level, corrosion due to inadequate maintenance, or any intervention carried out by an unauthorised third party.


Limitation of Liability and Safety Notice

The autopilot system is a navigation aid. It does not replace the skipper’s vigilance and watch-keeping duties under any circumstances.

Like any electronic device used aboard a vessel, the system may experience failures or malfunctions, regardless of cause: hardware component failure, loss of connection between the application and the control server, electromagnetic interference, extreme weather conditions, battery discharge, or any other hazard inherent to the marine environment. The Customer acknowledges and accepts this risk.

Accordingly:

  • The Customer is solely responsible for the handling and safety of their vessel at all times.
  • The autopilot must never be used as a substitute for proper watch-keeping.
  • In the event of a failure or malfunction, the Customer must be able to immediately resume manual control of the tiller.
  • The Company cannot be held liable for any direct or indirect damage, whether material or personal, arising from a failure, malfunction or improper use of the system.
  • The Company’s liability is in all cases limited to the purchase price of the product.

Intellectual Property

All mechanical designs, electronics, software, firmware and documentation relating to the autopilot system are the exclusive intellectual property of the Company. Any reproduction, resale or reverse engineering is strictly prohibited without prior written authorisation from the Company.


Personal Data

Data collected is used exclusively for the purposes of order processing and after-sales service. It is not shared with third parties, except for service providers necessary for order fulfilment. The Customer has the right to access, rectify and request deletion of their personal data.


Governing Law and Disputes

These GTC are governed by French law. In the event of a dispute, an amicable resolution will be sought as a priority. Failing that, the matter will be brought before the competent courts of the Company’s registered place of business.
